These Terms of Use (“Terms”) govern access to and use of the website and operational platform (the “Platform”) provided by Tollit Global AS (“Company”, “we”, “us”, or “our”).

By accessing or using the Platform, you (“User” or “Customer”) agree to be bound by these Terms.

1. Description of the Platform

The Platform provides an operational visibility system integrating:

  • Air cargo tracking at AWB level
  • Automated customs data processing
  • Shipment readiness coordination
  • Terminal and release signaling
  • Related analytics and automation tools

The Platform is a digital coordination and data processing system only.

The Company does not act as:

  • Carrier
  • Freight forwarder
  • Ground handler
  • Warehouse operator
  • Customs authority

The Company does not physically handle cargo.

2. Eligibility and Access

Access to the Platform is available only to authorized business users.

You agree to:

  • Provide accurate registration information
  • Maintain confidentiality of login credentials
  • Use the Platform only for lawful business purposes

We reserve the right to suspend or terminate access if these Terms are violated.

3. Use of the Platform

You may use the Platform solely for operational coordination of shipments within your organization.

You may not:

  • Reverse engineer or copy the Platform
  • Attempt to gain unauthorized access
  • Use the Platform for unlawful activities
  • Use the Platform as a standalone customs brokerage service outside the operational flow

4. Data Accuracy and Customer Responsibility

You are solely responsible for:

  • Accuracy of all shipment data submitted
  • Classification, value and description of goods
  • Compliance with customs, VAT, VOEC and IOSS regulations

The Platform processes data based on information provided by you.

We do not independently verify the legal correctness of submitted shipment data.

5. Customs Processing Disclaimer

Any customs-related outputs generated through the Platform are based on submitted data.

The Company does not guarantee:

  • Acceptance by customs authorities
  • Clearance timing
  • Absence of regulatory review

You remain fully responsible for compliance with applicable laws and regulations.

6. Third-Party Data Sources

The Platform relies on third-party systems including airlines, tracking providers, handlers and customs systems.

We do not guarantee the accuracy, completeness or timeliness of third-party data.

Delays or inaccuracies originating from third-party systems do not constitute breach of these Terms.

7. Operational Disclaimer

The Platform provides coordination signals and status information only.

We do not guarantee:

  • Cargo handling priority
  • Release timing
  • Delivery performance
  • Airline schedules
  • Terminal processing speed

Operational decisions remain the responsibility of the User and relevant logistics operators.

8. Fees and Payment

Access to certain features requires a paid subscription.

Fees, billing terms and payment schedules are defined in the applicable service agreement or order confirmation.

We reserve the right to suspend access for non-payment.

9. Intellectual Property

All intellectual property rights in the Platform, including software, automation logic and design, remain the exclusive property of the Company.

You are granted a limited, non-transferable right to use the Platform during your subscription period.

10. Data Ownership

You retain ownership of shipment-specific data submitted to the Platform.

The Company retains ownership of:

  • Platform architecture
  • Automation logic
  • Aggregated and anonymized operational analytics

11. Limitation of Liability

The Platform is provided “as is” without warranties of uninterrupted or error-free operation.

To the maximum extent permitted by law, the Company shall not be liable for:

  • Indirect or consequential damages
  • Loss of revenue or profit
  • Business interruption
  • Data loss
  • Delays caused by third parties

Our total liability shall not exceed the fees paid by the User during the preceding 12 months.

12. Suspension and Termination

We may suspend or terminate access if:

  • These Terms are violated
  • Payment obligations are not met
  • Regulatory risk arises
  • Illegal activity is suspected

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

  • Government actions
  • Customs system failures
  • Airline disruptions
  • Strikes
  • Technical outages

14. Governing Law

These Terms shall be governed by the laws of Norway.

Any disputes shall be resolved exclusively by the courts of Oslo, Norway.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.
